US Judge Orders Freedom of Abrego Garcia from ICE Custody

A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The situation stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to face human smuggling allegations, he was detained in immigration detention.

In her decision, the court noted that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
